PRIVACY NOTICE

PRIVACY POLICY REGARDING THE PROCESSING OF CUSTOMER PERSONAL DATA PURSUANT TO ARTICLES 13-14 OF EU REGULATION 2016/679 (GDPR)

This privacy notice is provided to Customers pursuant to Article 13 of EU Regulation 2016/679.

 

Data controller

The Data Controller is Effepark srl, with registered office in Como, Via Pasquale Paoli, 114, VAT no. 03408340135.

 

DATA TYPES

The Processing relates to the Customer's Personal Data (first name, surname, company name, address, landline/mobile telephone number, email address, VAT number and any other information relating to the Customer).

 

PURPOSE OF PROCESSING

The processing of personal data is based on the principles of fairness, lawfulness, transparency and the protection of the customer's confidentiality and rights, and is carried out for the following purposes:
a. organization and implementation of activities connected and instrumental to the planning, initiation, conclusion and execution of contractual relationships;
b. performance of obligations arising from the contract concluded with the Client;
c. compliance with legal obligations of an administrative, accounting, civil, tax, regulatory, EU and non-EU nature;
d. general management of the customer relationship (acquisition of pre-contractual data and information, contacts, correspondence, orders, deliveries, invoices);
e. litigation management (contractual breach, formal notices, settlements, debt recovery, judicial disputes);
market research, sending of advertising material and promotional activities (sending, including via email, of information and communications relating to technical and commercial services, value-added services, pre- and post-sales services, news and promotions), subject to the Customer's consent.

 

PROVISION OF DATA

The provision of Data is compulsory and any failure to provide it, or its partial or inaccurate provision, may result in the impossibility of fulfilling contractual obligations.

 

Consensus

Consent given for carrying out market research, sending advertising material and promotional activities can be revoked at any time pursuant to Article 6 of the GDPR.

 

METHODS OF PROCESSING

The Processing is carried out using manual and/or IT and telematics tools with organisational and processing logics strictly related to the purposes themselves and in any case so as to guarantee the security, integrity and confidentiality of the data in compliance with the organisational, physical and logical measures provided for by the provisions in force. The Customer's Personal Data are processed for the entire duration of the contractual relationship and subsequently for the performance of all civil and tax legal obligations.

 

Data transfer

The data is not transferred outside the European Union, but the Data Controller reserves the right to change the location of the servers even outside the European Union, ensuring, in such a case, that the transfer will take place in compliance with the legal provisions and appropriate safeguards.

 

DATA RETENTION

The processing and storage of data take place on servers located within the European Union, where applicable also by third-party companies appointed and duly designated as Data Processors. Personal data is stored in such a way as to allow the identification of the data subject for no longer than is necessary for the purposes for which it is processed and, in the event of revocation of consent, it will be deleted.

 

DATA SUBJECT'S RIGHTS

The Customer may, at any time, request:
1. the right to access personal data;
to obtain the rectification or erasure of the same or the restriction of processing concerning him or her;
3. to object to processing;
4. data portability;
5. to withdraw consent, where applicable: the withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal;
6. to lodge a complaint with the supervisory authority (Data Protection Authority).
